In the case of Eviction, there are some rules to follow when making a change to the lease or terminating the lease. Whenever there is a bad tenant situation, you will need to prepare to use one of the following methods to change the lease:
If a bad tenant situation has gone too far you need them out as soon as possible, how do you do it?
- It is possible to terminate the lease with 14 days clear notice using the “Landlord’s notice of termination of tenancy for Substantial Breach Form” (see resources). There are several reasons you can evict the tenants that have breached the terms of the lease, and they include:
- The tenant had not paid the rent in full every month on the due date. (The tenancy will not be terminated if, on or before the termination date specified in this notice, the tenant pays the rent due and any additional rent that has become due under the residential tenancy agreement as of the date of payment.)
- The tenant has interfered with the rights of the landlord or other tenants in a significant manner in the premises, the common areas or the property of which they form a part.
- The tenant has performed illegal acts or carried on an illegal trade, business or occupation in the premises, the common area or the property of which they form a part.
- The tenant has endangered persons or property in the premises, the common area or the property of which they form a part.
- The tenant has done or permitted significant damage to the residential premises, the common areas or the property of which they form a part.
- The tenant has physically assaulted or threatened to physically assault the landlord or another tenant.
- It is possible to terminate the lease with 24 hours clear notice using the “Landlord’s to Tenant 24 Hour Notice of termination of Tenancy”.
- The tenant has done or permitted significant damage to the residential premises, the common areas or the property of which they form a part.
- Has physically assaulted or threatened to physically assault the landlord or another tenant.
- Another option is to wait until the lease is nearing expiry and notify them you will not be renewing the lease.
